I do not know what to do

Ok, here is the issue. I have really bad credit. I have tried to get loans from everyone and have beed denied because of past dues. The past dues can from me being sick and I could not afford to pay the bills. Everything is behind and I am a frequent visitor of the payday advises. I have 3 loans out already. Everything is behind and I have a house and child to take care of. What are my options because right now I don't have any money in the bank to by food.

The first thing that you have to do is stop with the payday loans. Then you need to look into the laws in your state regarding medical debt. Many states have programs to help you ay for your medical treatment and some even have laws about how they maybe collected on.

Now, if you just have reg UNSECURED debt (credit cards etc NOT your house, car) you need to worry about feeding that child before you worry about them. Look into nay state assistance that you can get for that and they ONCE YOU HAVE THE MONEY. Either start DV to start the settlement process or, call you DC to work out a payment arrangement. Dont forget to get a pay for delete agreement in writing!

If you have children, they are the FIRST priority!! They need a roof over their heads and food on the table. I know it seems difficult sometimes. I've put bills off to get groceries, etc. PDL's can really 'eat up' your paychecks.....fee after fee after fee! One day at a time........

It is really sad to see a situation like this. Recently a car accident put me in the same situation. I still find myself drowning and barely hanging on. So what I mean to say you are not alone. These posters give good advice, your children must come first. You also must not beat yourself up over this turn of events. Somehwere down the line it will all work out. YEP......kids should ALWAYS come first. I love my son to death!! He's the light of my light!! I'm very proud of my son! TWEET......yep..everyone on this forum has 'been there' at one time or another. Why don't don't you think about this: Things WILL work out for you. Do ya know why? Cuz you're helping yourselve TO work them out. I remind myself of this constantly..i think it actually reduces the stress level, at times. Hope this helps.

It probaly does help alot. Sometimes though the mountain becomes harder to climb. I take a look at my bills and think it may not look to bad on paper but if I was to sit down and figure out how much I could send and when they would be paid off I relize this isn't an overnight fix or a year fix. Makes me a little sick in the ole belly.

I too agree with others in this forum that the first priority is your child. Since you have no money in your bank to feed your child, I suggest that you can rent out a part of your house and live on the rent. Later you can contact your creditor and settle for a repayment plan and repay the existing loan slowly from the rent.

Fixing your credit is NEVER an 'overnite' thing. It takes time......so many people get 'down on themselves' BECAUSE of this, I think. Work at issues, little by little. It will work out for you, one way or another.

If you take the attitude that you need you credit fixed fast the CAs will pick up on this and use it against you. If they feel that all they have to do is wait you out and you will fold. They will make your credit repair a nightmare. You need to relay the attitude that you have all the time in the world and it's your way or the highway. Now don't go nuts with that attitude and get yourself sued!

I too think that you should think over the matter in cool mind before taking a decision because a quick decision may worsen your situation. You can also check whether or not you can get a debt consolidation loan. The suggession of renting a part of your house to earn some money to pay off the debt seems good to me.

I dont know about renting out part of your home. If the water heater in the second floor of your home breaks can you aford to fix it? If your tenets dont pay you, can you afford to evict them? As a landlord you have to fix what breaks and fast Be careful with that.

Renting a part of your home is no doubt a good idea, but there are also problems associated with it because if the tenant does not pay the rent in time you cannot simply evict him by going to the police. For this you have to go to the court and get an court order to evict the person. But as per the New York state laws, the landlord has to give a three day's notice to the tenant in writing that if the tenant does not pay the rent in three days' period, his tenancy will be terminated and then only he can go the court for eviction order after the three day period.

The process of eviction is also not so easy. Even after giving a three day notice period, there are a lot of other steps to follow. For this you need to file a complaint with the court and wait for a hearing date. The hearing date is minimum of 5 days from the date of service. The court then gives the order on the hearing day or on the following day and then the tenant must be given a 72 hours notice before he can be evicted.

Paying off old debt, will restart the clock on the collection activity for that account. The law states the LAST ACTIVITY. which includes payments. You are doing an injustice to yourself by paying a old debt.Have them removed instead.

I think that you should go for a debt consolidation loan to pay off your dues. You should pay off your dues first because if you don't pay the debt, your creditor may sue you to the court which may even result in garnishing your wages. So it is better to first pay off your pay day loans with debt consolidation loans.

I think that steps has to be taken to see that these payday lenders does not charge abnormally high rates of interest. I heard that recently Pennsylvania Department of Banking has filed a lawsuit against Advance America for charging abnormally high rates of interest and fees, which is beyond the permissible limit under Pennsylvania law. This is what I feel is a step forward towards limiting the interest rates on paydday loans.
