To make a long story short - we have poultry farm- operation expenses went up so high that we both depleted our 401K and beginning using cc. We couldn't get the farm sell for the past 2 yrs and didn't want to file BK, so we joined CDC to help with our conslidation. with 14 of our CC we were able to settle 2 of them since April 2009. On 4/15 we received a summons from Capital One for court, I send over the summons to them, they inform me that they are in the processing of negotiating with Capital One. I do not have a problem showing up for the summons but I have no money to pay anyone I'm MAX out. - had to cancel my health insurance cut most of expenses back - DO NOT WHAT ELSE TO DO!!! My husband is so stress - at the point of no returns!!! we both are working 12 hr shift jobs and still can't make it??? PLEASE ANYONE -APPRECIATE IF ANY INFO/SUGGESTIONS.

why don't you want to file BK? I' m not saying you have to but talk about it.

Hi Jvue,

Whatever negotiation your credit counseling agency may achieve, you need to answer to the summons. You can take help from your counseling agency to answer to the summons. You can also visit the court where the case was filed, and take the help of the court clerk to answer to the summons. You may mention in your answer that you are taking the help of a counseling agency to settle your debts.

Just like cinnamngrl, I would like to know why you don't want to file bankruptcy?

Thanks,

Aaron

Hello Everyone,

Thank you so much for the information so far..

We felt obligated to the creditors that we owe. We leased our farm out with potential of that person buying the farm and joined CDC to consolidate all of cc so we can pay our creditors back. We also have two cleaning business on the side and didn't want to loose any of these due to my brothers and sister-in-laws borrowing the funds to open these two business so we can pay our loans back without having the income from the farm.

Thanks so much for your help so far!!!
