Dispute a charge off.

My ex-husband charged 110K on 2 business cards from Wells Fargo last year. In our divorce, which is four years old, he was given all assets and debts associated with our business along with the business itself. Wells Fargo sent me a letter asking for the money because I was a guarantour on the cards. They said it didn't matter that the charges happened after the divorce. I do not believe I even signed up for these cards, my ex used to sign my name all the time. One of the cards is secured by a home that sold in 2006! I sent Wells Fargo a letter asking for proof and disputing the charges (registered mail so I know they got it) and I have heard nothing in 2 months. What next?

You need to file a complaint of fraud and send a DV letter. There should be some kind of signature card or application because there is no way to cosign online or over the phone.

how were the debts given to your husband? You may still have to sue him.

You should first send a certified "debt validation letter" to the company. You will get a sample validation letter at http://www.creditmagic.org/repair/sampleletter-debtvalidation.html .

They perhaps will not respond to your validation request, or will not be able to provide a proper validation. You can then dispute this item. You can also file complaints with the Federal Trading Commission and your State Attorney Genneral.

when I say complaint of fraud, I mean a police report. Have you spoke to your ex?

Thanks so much you guys! I used the DV form letter and tinkered with it to make it fit and sent it out registered mail today. Now with the complaint of fraud, do I just go into my police station to do that? If they do not respond what is my next step? Do I hire a lawyer, and if so what kind?
