Subject: Y they ask for identification & How to deal with Collect

For everyone who has to deal with collectors here is a lil inside... When collectors call you and say the usual "yes hello my i speak to John Smith." "good morning mr. Smith, my name is JANE are you still reciving mail at 1234 Main St." They have you verify info for the simple fact that they dont and should not give out any personal info of yours or anyone elses. As much as you want to protect your identity they do to. By them not verifing any info from you could be a million dollar law suit. DID YOU KNOW??? did you know that you can sue a collection agency 1,000 dollars per FDCPA violation.
Trust me a collection agency is going to do anything posibble to protect their asses, so i suggest that if your in debt you learn your FDCPA laws to make sure you are gettin treated fair.

CBE : is a great company very by the book type of ppl and company they are trying to change the collection world.. they are more about helping the consumer and keeping there clients happy so they are in a win win situation...

Encore RMI : is a thin line type of company. They are on the verge of violating FDCPA all day everyday. would hate to be you if you have to deal with this company

NCO : this company is pretty bad too... rude collectors ive had a couple that have called me that dont even have me verify any info they go straight for the kill "is this JANE DOE." all i say is yes and they run into the Mini Maranda for all they kno its another Jane Doe n just let them know i have a debt.

i have and they are a pain and liars , mine was for a student loan that the dept of education conveniently separated from my loan by accident so it was their fault to begin with! and these losers got the account. they violated numerous FTC laws, lied to me, verbally denounced me over the phone, hung up on me 3 times,would not work with me, sent me to garnishment dept well before the law states it should get to that point, currently it is paid thanks to a member of my family however my congressman had to involve himself as well as my lawyers and even after the fact i am contacting my senator and the attorney general and my attorney. i would call them and one person would tell me one thing and then in the next call they would deny i ever spoke to that one particular person. WATCH THESE PEOPLE LIKE HAWKS, AND GET A LAWYER INVOLVED FROM DAY ONE....they offered to settle for a lower amount if i paid it that day and thats all they said, i told them i would call back and they said ok. my family member called and paid but they charged her the full amount instead of the settlement amount when i called back to tell them it was too much they said well no one here has the authority to lower the amount, and i said i dont care that was a rep from your company and it was offer so you pull the taped phone call. the supervisor came on the phone and said it was null in void bc i didnt accept the offer at the moment. however, according to my lawyer they have to accept 80% of the full amount if your willing to pay up front as well as they have to say a disclaimer that the offer is only valid if you accept it at that very moment...which they never did. My advice to you is get an attorney these people are the most horrible creditors on the planet, i do not know how they sleep at night.

Do not confirm your information over the phone if YOU do not initiate the call. I am already personally dealing with fraud and possible identity theft. I am not taking any chances with CBE or anyone else. I told them to use the US Postal service.

Subject: If I owe a creditor/collection agency...

I have several debts which I know to be accurate. I have received multiple letters/calls regarding these accounts over the years (most in collection). However, I just pulled my free annual credit report from all 3 reporting agencies, and the debts about which I am most anxious aren't even on the report! Should I send a DV letter & then a letter to pay for deletion, even though it hasn't been reported yet? Or is this exactly the time to do it - before it hits my report? And why would some things show up right away & others not for a couple of years (but still within SOL for Illinois)? Am I just opening a can of worms, or is this a great opportunity for me to resolve some of my debt issues? Thanks veru much for the help!

Yes, definately send a debt validation letter, that way if they do report it to your credit report you can then use the debt validation as proof. Make sure that you send thme certified mail, return reciept requested so they can not ignore them.

Once you get validation or not receive anything from them you can then come back here and find out what to do next. Goodluck, hopefully with some help here you can get it all straightened out.

You can also get the statute of limitations for credit card debt by googling Illinois SOL on credit card debt. If you can not find the information one of us can get it for you. If these creditors are sending you collection letters I would get the debt validation out (with return reciept as goodnatured said) as soon as possible. Usually once they start trying to collect a debt it is not very long before they will start listing it. You can look on your credit report on the last few pages and it will show you who all has viewed your report. Look their and see if any of the collectors are pulling your information.

oh yes, any activity at all will provoke them, they are called ticklers, once the file is tickled, some type of activity, it alerts them that you are alive and kicking. Then they start the collection calls and efforts.

Isn't it something that they will alert a collector about activity on your report but will charge you for it. I don't think they should be allowed to give your information out like that, should be considered a privacy issue.

You know I know for a fact this is true. I had a couple bad accounts on my record. One was way past the SOL and I looked at my report to see if the other one was here about a year ago. As soon as I did that the mailbox filled up and the phone started ringing. My brother who has pretty much been going down a bad path all his life has more defaulted debt than anyone I know...even a couple bank loans. he never checks his credit and they have never bothered him except for a few noted in the mail.

Maybe because he has not applied for anything in a while, as soon as he does they will be all over him.

Thats what I thought. The only good thing I guess for him is the fact by now all these debts have got to be way passed SOL. He does n ot have a phone in his name but I do not hear any relatives complaining about phone calls. It would be a waste regardless.

lol. Did you ever find the answer we were looking for to that one question about if a collector can add interest charges after a debt is sold? I thought only the origianl lender could do this. What we need on here is someone who use to work for debt collection agencies that can answer these questions. We have had a person or two come on here and there but they never stick around.

Guess they get tired of dealing with debtors, think about it, if you fry burgers all day, that would be the last thing that you want for dinner right? LOL, no wonder they run off, I would too.

Nice one. I can see your point. One thing there are probaly as many debtors in the world as quarter pounders. Sad but true.

ok, get you, so are you supersized or a value meal. I am working off the dollar menu this week, Just bought a new car and the down payment broke me, can't wait till friday, payday, can't get here soon enough.
