I stumbled on this web-site trying to gain info about Hanna and Assoc. I am wondering if anyone has ideas on how to deal with them: The situation is my CA, BOA charged off my account by accident. I have a payment arrangement with them that is current. BOA reversed the charge off but now Hanna has my info and have been calling, harrassing and threatening me to collect on the debt. My fear is regardless of what I say they will continue to pursue this. Suggestions?

Hi guest
You can ask for debt validation from Frederick J Hanna and can wait for 30 days from the time they receive your letter. Unless they validate your debt, they cannot proceed further to collect the debt amount from you. I think that Frederick cannot validate your debt. So in the meanwhile you may continue to repay the debt as per arrangement with BOA.

I agree with Anthony because a debt can not be sold to two CAs at the same time. Find out whether BOA has sold it off to Frederick J Hanna or not. But I don't think they had sold it off because your repayment arrangement with BOA is current and you are paying it off in time. So sent a DV letter to Frederick and continue paying off your debt to BOA if they had not sold off the debt.

Definately get the debt validation from the start. Why would they do this if you had an arrangement and was current on it, that makes absolutely no sense and they wonder why people don't want to deal with collections.

Thank you to everyone for your response. I will write the letter as recommended. Being new to debt collection and now being in the wrath of Hanna and Associates is a real eye-opener. I want to use every means possible to expose these people. After exploring the web they have been in court over 20 times this year violating the protection act. Debt collection should not be above the law or allowed to destroy peoples lives. Shame on BOA for doing business with these people.

There are laws that they should follow, unfortunately, in some cases this does not happen, they harrass and treat the consumer badly. You may want to report them to you state attorney generals office, this will get their attention. goodluck.

I have a lot of credit card debt and I had an atty try to settle these accounts as I would borrow money from a relative, settle for less and pay him back. The atty and I got to an amount that I could settle on and discover and Chase would not send a settlement letter and I could not follow through. I am now getting a ltr from Frederick Hanna on 1 Chase acct ( I have 2) telling me that if I ask for validation of debt they will send a judgement. What should I do now?? Thanks
I am still getting a bill from Discover. Does that mean that it has not been charged off and they said it would be?? I cannot file for b/r because of my house. I cannot afford any payments

I have a civil case against me now brought by Hanna on behalf of Unifund on a defaulted 29% credit card of B of A. They are nasty folks..... You shoud not be surprised that B of A uses scumbags like Hanna. They are one of the biggest scumbags around and should have gone bankrupt last year...... I think they have violated every part of the the FDCPA so far with me.

I would be willing to settle but they have offered none. Just a civil case for the full amount. $7100 + $4300 in fees. At least they have not won by default. I hope to get the case dismissed. Depends on the judge really....

The irony is if they had left my interest rates reasonable so I could pay I would be making payments like I do on all my other debts.

Emery,
Have you filed any complaints against them? If so be sure to take these records with you to court. How old is this debt? Is there any chance it could be protected by the statute of limitations? You need to also make sure this debt is validated. If you can give us a little more info maybe we can help you out somehow. Let us know.

Hi Little,

Send a debt validation letter to Fredrick Hanna. In the meantime make a copy of your monthly income and expenditure. After you receive the debt validation, check if you really owe the debt. If you do owe, you can send a hardship letter to the company, along with the copy of your income and expenditure, mentioning that it won't be possible to pay the whole amount. Add that you would like to pay the dues but request them to lower the amount to be paid.

Hope this helps.

i am dealing with hanna law office on a boa card debt, the first collector i spoke to said he would send a settlement offer in the mail, yesterday another person form hann's office called saying that i am lying that i never received the agreement. now i get a letter stating that i agreed to pay monthly amounts, i have never agreed to pay anything so far. i would like to settle but they will not send the offer in the mail and now they are claiming i agreed to something i did not. i have the settlement amount and want to pay this, yet i am getting nothing to a sure me the offer they made it real. i would rather pay fia card services directly and speak to them only, as they do still own my debt. fredrick hann's office is making it impossible for me to pay anything as they keep changing and lying. and will not send agreement in writing. now they are saying the person i was talking to no longer is who i am supposed to talk to. how am i to pay them and get this done? i now afraid to send anyone any money on this debt. why are they not willing to send it in writing?

Hi,

What you can do is send a debt settlement letter to the company mentioning your settlement amount. Send this letter through certified mail, requesting a return receipt. You can then have a proof of your settlement. After they answer back, you can start your payment process.

Hope this helps.

Aaron

If I made an agreement with Fredrick's is it too late to ask for debt validation.

Hi anonymous J,

If you have already agreed to the terms of the company, you need not send a debt validation letter to them. As you have agreed to the terms, it implies that you owe the debt to the company. Debt validation letter is sent to a collection company when you aren't aware that you owe an amount to the agency.

Hope this helps.

Aaron

I have a law suit from Frederick & Hanna Associates and I have just a week to answer the summons and I am not sure if I should contact the law firm and work a deal with them or should I go to the court and answer the summons as I really do not know. I need some advise. Please help!
