Bad Collection Agency

I have sent a collection agency(Arrow Finanical) a validation letter, they then turned around and sold the account to another collection agency. Can I contact the credit bureaus and tell them what practice this collection agency is doing and have them remove the account and stop the collection agencies from selling the accounts. This act was because the account could not be validated and the original collection company was not registered in the state I live. Any help is excepted.

file a dispute with the credit reporting agency and send copies of everything along with it as proof that they did not validate.

I don't think they should be able to sell a debt that they can not legally collect. Just another screwed up practice of the collection agencies.

The credit bureaus can do nothing if a collection agency sells off a debt to another collection agency. Now since you have asked for debt validation to Arrow Financial and they have not validated it, all that you can do is to ask the bureaus to remove their name from your report if it appears there. Normally a CA sells off a debt to another CA if they cannot validate the debt.

Since Arrow Financial sold off the debt to another CA, it means Arrow Financial do not have any proof that they own your debt. Therefore it implies that the CA, to whom the debt was sold by Arrow, will also be unable to validate the debt. So, I think that you should not pay off the debt to any CA until you get a proper debt validation, because nobody will be able to provide you with DV. Now, since you can only remove the CA listing from the report by PFD and not the OC listing, which will stay there for seven years and affect your score, you need not worry about removing the CA listing from your report.

Credit Bureau is not the perfect place to report about the mishaps of the CA.One more thing is you should not get worried until and unless CA is not validating your loan.

If they validate the loan then the next course of action comes into the picture.that is repaying.So do not pay them till the point they are not validating the loan. :wink:

My Husband and I were just summoned from arrow services for $1500 we have no idea what for or where it came from I have not recieved any letter from them now we have been served for a law suit for 4 years ago.How do we find out what this about the summons says we can't call there lawyer they just give us a court date plus fee's what do we do?

Marlene9102, if the lawsuit is 4 years ago, then isn't the statute of limitations run on the suit. I would say to countersue claiming a FDCPA violation. It is a 15 USC 1692 violation which is a Federal violation. I know it is a pain, but if all else fails you can contact your attorney or fight them yourself. I countersue these CA's all the time for people but I am in Missouri where we also have corrupt courts and judges.

Sounds like a typical collection agency tactic. You should definitely dispute the charges via a credit reporting agency, even all 3 to be safe. I suggest running your credit at least once a year. Non-profits like our agency provide free credit report analysis and help clients explore where they’re at, where they want to go, and how we can help you get there and achieve financial freedom.

Checking your credit report is a must. What I have seen recently is when they sell these accounts sometimes they change the account number. I recently ran into this with a debt past SOL. I looked into it and found when one credit card company sold out to another they issued the account a new number and a new start date. It took a lot of research to see where the debt had originated but for someone who is not familiar with these debt collection practices it could have been another story.
