I wrote this article about Capital One. This is a specific list of instructions that apply just this one credit card. I thought it would be helpful because so many people have problems with them. I wonder if it is a little risky to single out one company, but I think there is a need.

I think lots of people who have visited this site and others like this have found the credit world a lot less scary. People don't relize how easy it is to help yourself improve your credit. Most do not need these repair agencies. It is like throwing good money out the window and now a days who can afford to do that.

Could you explain a bit further? What exactly is involved in the civil claim aspect? I love a good cease and desist letter and recently sent out a few because another persons creditor kept calling me . Same place just different telephone numbers. They would say they were not the same company but when they left messages leaving there company name. Must have thought I fell off a turnip truck.

No I didn't send by certified mail and I relize the mistake in that. I just get really annoyed that I have to do any of this to begin with. Then to turn around and pay to have stuff sent certified for a debt that is not mine. I haven't heard since the last letter I sent so I imagine they are selling it off agian but in the mean time I will have a month or so of a less active phone.

these are the steps to follow if you have problems with your Cap 1 account

Step1
Identify the source of these charges. The main sources of these charges are a. Late fees b. Over Limit fees c. Negative entries on your credit report. Your response depends on why your account was late or over limit. It is extremely helpful to have on line access to your account.
Step2
If you made an error timing your payment or calculating your credit limit then contact CapitalOne by phone and ask for help. If you have a good payment history then they may be willing to rescind the fee as a courtesy. Be sure to mention that you are very concerned about your credit history. Monitor your account on line and make sure that the charges are reversed with the next 5 business days. If you feel that penalties were applied to your account in error: Call Capital One immediately and write down the name of the person on the phone and the time and date of your call. Explain the problem, and request that the charges be reversed. You should specifically ask if your account will be reported as delinquent to any credit reporting agency. If Capital One agrees to reverse the charge then monitor your account on line to be sure that the customer service follows through. Do not expect the customer service agent to admit any wrongdoing on the part of Capital One. Stay focused on your credit history and the money you owe.
Step3
If Capital One does not agree to reverse the charge or does not follow through with an agreement to reverse the charges then Write a Letter to Capital One by Certified Mail with Return Receipt Requested. a. Explain the problem on your account and request that the charges be investigated and reversed. b. Identify the person you spoke to previously and state that the problem has not been resolved. c. Request a response with 10 business days stating that you are concerned about more charges will be added to your d. End the letter with “Please consider this a letter of demand.” Address the letter to Address this letter to Capital One Attn: Customer Relations PO Box 85015 Richmond, VA 23285-5015
Step4
In a few days you will receive a green USPS Return Receipt card. At this point you will want to make a file with your original letter to Capital One and the RR.
Step5
Wait 10 business days from the day that Capital One received your letter
Step6
At this point it is extremely likely that you have received at least an acknowledgment from Capital One. They will often send a short letter stating that they have received your letter and they will respond in a reasonable amount of time. If you have received this letter wait 30 days from date that CapitalOne received your letter (date on Return Receipt), before taking the next step.
Step7
Obtain copies of your credit report from the three main Credit Reporting Agencies. This may be a little early to be helpful, but if you getting free reports they will come by mail and that can take time.
Step8
If problem has not been resolved at this point send a 2nd letter to CapitalOne. This will pretty much be the same letter with a copy of the Return Receipt and stating that this is the 2nd letter to CapitalOne without a resolution to your problem. Address this letter to Capital One Attn: Customer Relations PO Box 85015 Richmond, VA 23285-5015
Step9
When you receive your 2nd green USPS Return Receipt make a copy of both return receipts together. I prefer scanning it into my computer but if you don’t have a scanner then copies are fine.
Step10
Go to http://www.occ.treas.gov/ConsumerComplaintform.pdf and download the complaint form. I suggest that you fill it out and fax to the 1-713-336-4301. There is an on line form but if you fax it then you can include copies of your return receipt and other supporting documentation. You can also mail a letter to Office of the Comptroller of the Currency Customer Assistance Group 1301 McKinney Street, Suite 3450 Houston, TX 77010-9050 1-713-336-4301 (Fax again) The Office of the Comptroller of the Currency is the federal agency that regulates CapitalOne. It will take approximately 30-60 days to investigate your complaint. They will send you a letter acknowledging your complaint.
Step11
Go to http://www.scc.virginia.gov/publicforms/127/complaint_form.pdf and down load the complaint form and fill it out. You can mail or fax this form to: Virginia Bureau of Financial Institutions 1300 East Main Street, Suite 800 Post Office Box 640 Richmond, VA 23218-0640 (804) 371-9657 (804) 371-9416 (Fax) You should receive an acknowledgment of your complaint within a couple of weeks.
Step12
At this point you need to stop and think. I am about to suggest that you send a third letter to CapitalOne by CMRRR. Now if you have one $30 late fee, this might not make sense and that is fine. It is very important that you adapt these instructions for your particular problem. If CapitalOne is charging off your account and putting negative entries on your credit report, then I believe it will be worth it to spend a little money on postage. This letter should contain copies of your return receipts, a copy of the letter from the Federal Reserve, and the letter form the VASCC.
Step13
Hopefully you receive a letter from CapitalOne stating that they will resolve the problem. It is not possible to guarantee results with this method because each problems is different. This is about being the squeaky wheel, not proving CapitalOne wrong.
Step14
Pay off your account with CapitalOne and close it. If you don’t agree with the way a company does business it is best not enter a financial contract with them.
