Con Artists for sure Matt. Its for the best that you have filed a report. I really dont understand how these scumbags survive with so much fraud added to their credentials.

Sometimes we ALL hit 'financial struggles' and if we could pay our overdue bills, RIGHT AWAY, I'm sure we would. We need a roof over our heads and food on the table FIRST..ya know?

Does this company really operate in so many places? How about the earlier question of how these places stay in business when they have so much fraud associated with their name? I wonder also how do they egt away with it? You would think if they were penalized more often then they would not be able to stay in business.

Many of the collection companies operate as franchises, and it's best to contact them to see which office they are operating out of if they call/mail you. They hide behind their multiple locations as a defense for not having responded to validation requests...

Is there many ways to keep this from happening? I would think that ifr you would call and ask for the information they may knowling give you the wrong info. What about the address on the envelope when they mail out collection letters?

Usually they will say that they sent that out from the mailing office, as was mentioned above they will say that they have many offices and that each of those offices have a different function.

So does this erve as a good defense for them? I guess what I am asking is if it would go to court and they never validated can they use this excuse to the judge and get away with it?

They won't fight, generally... As soon as they know you'll go after them, they'll just offer to "forget about the whole thing..."

Most folks are happy to do just that...

I have one that is still lingering, this christmas will be two years since they served me with a summons, I swear that they thought I would just roll over and pay it. I sent debt validation and only recieved a copy of the bill the first time, second time a bogus affadavit, so I told them I would have this person subpeoned, or the affadavit is heresay. Any way, probably a year ago they said that it would go into arbitration, well I am still waiting to go to court.

Doc, how long can they drag this thing out before I can file something to get it all dismissed, hell criminals have a timeframe for speedy justice, shouldn't debtors.

any advice would be appreciated.

Depends on the statute of limitations in your state... If they filed prior to the expiration of the SOL, they're fine. If there's a limitation in your state on how long they can keep it open without activity is something to ask the court clerk in the city/county where it's filed. Here, I believe it's about a year...

I keep getting a recorded voice message from these people...looking for my adult daughter. They leave a "case number" but go thru the message so fast, you hardly have time to write anything down. If they are serious about collecting why don't they have a live person call so it can be discussed?

They probably have many cases that they are working on and know that if the person calls back then they have a chance at collecting. If you can let the message go to your voice mail then you will be able to get the number, call them back and tell them that they have the wrong number that she does not live there. I would not give them her number with out her permission, I would not want anyone giving them my information.

I try that, sometimes, with CA's calling me: telling them they have the wrong number, etc. Yet.......they continue to call back.

The fastest way to get a response from a collection agency when youv've been submitted to them in error is to file a complaint with the Attorney General's Office. I work for a collection agency and we put those high priority. It will push them to investigate and resolve the issue immediately.
