If you are trying to delete a collection agency from your credit report then I recommend using the hippa to your favor.
HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT (HIPPA), To amend the Internal Revenue Code of 1986 to improve portability and continuity of health insurance coverage in the group and individual markets, to combat waste, fraud, and abuse in health insurance and health care delivery, to promote the use of medical savings accounts, to improve access to long-term care services and coverage, to simplify the administration of health insurance, and for other purposes.

| How WOULD you use this..I mean, do you write a letter to the CA explaining how your private info has been violated? i work with a company ( I work with the Elderly..) they REALLY stress the HIPPA. Yep..it IS worth a shot. |

| I am not sure how you would do this but I know there would almost have to be a way. I am glad they put HIPPA in place. I know its aggravating always signing all those forms but it use to be anyone could look into your private business. I use to hate when you went for a loan and then a few weeks later you would recieve all those flyers and credit apps in the mail asking you if you needed their service. A lot of this was cut down by HIPPA. SD what type of work do you do with seniors? I use to live next to an "old age home" and most were pretty decent to talk to and some actually very pleasant...Now of course you had the "others" but I never said a bad word because I had no idea what they had been through in life. |

| FIREYONE..I do 'Home Health Car'...go into their homes. Thsi way, they can STAY in thier homes, instead of going into a Nursing Home, or something like that. I take care of the Handicap, too. I have a 'regualr' client and I fill in for others, as well. My 'regualr' client has MS. She needs ALOT of help with things. She is such a sweetie! I love helping her out. I think you should be happy with what you do as employment. You could give me a ZILLION dollars an hour to work in a field that I'm not happy in...I would be miserable!! |

| That really sounds like a wonderful and fullfilling job. I am glad their are people like you out there. For over 10 years I lived next to an old age home and it was really sad to see the neglect. Not only from the staff but from their own family members. It is really sad around the holidays. My daughter use to go over and color and do other activities with them but when a new owner took over that stopped because the person considered hera liability. She was really heartbroken. |

The way I would use the HIPPA is, see below for a short sample.
To Whom It May Concern,
I have recently reviewed my credit report and noticed you are reporting a derogatory collection item. After reviewing my records, I can find no contractual obligation between your company and me that makes you a person entitled to collect anything. Therefore, provide me a certified copy of an original contract, showing my signature, specifically naming your company as a person entitled to enforce a commercial claim against me.
Additionally, the Health Insurance Portability Act of 1996 (HIPAA) protects my privacy and medical information from third parties, such as yourself. I do not recall giving permission to (name of medical provider) for the release of my medical information to you. Therefore, in addition to providing me proof of contract (between you and I), you are also required to contact the medical provider associated with this account and request they provide me a certified copy of an original contract, showing my signature, specifically authorizing the release of my medical information to you.

| Taffy if it is the hospitol that stills holds the account you will not need to send them the letter. Only send the letter to third party collectors trying to collect on the debt. It is like a form of validation so you should mke sure you send it return reciept requested. They then have 30 days to prove they own this account legally,which more than likely they won't. After that you may dispute the items on your credit report and have them removed. |

If the debt is past SOL, you need not send any letter to the collection agency. Just wait for the seven year time period to expire, and the negative debt listing will be automatically removed from your credit report. However, if the Statute of Limitation on the debt has not expired, then as Fireyone said, you can send the letter by certified mail with return receipt as a proof. _________________ Keep in touch

I will send letters today and see what happens............Will keep in touch. I believe this is the best site I have come across during all my years of surfing the net (LOL). with all this Knowledge you guys should get together and make a plan to make the Credit Companies have better standards and guide lines and send it to the President....... who knows he seems to want input on our problems.
