Subject: Venue Questions

If a collection attorney has filed suit in a county that I don't live in, can I file a motion to dismiss the suit based upon jurisdiction? I haven't been served yet, but I already saw the suit filed, and it is filed in a county that I moved from many months ago.

Hi Maleena,

You have not been served yet? Then where did you figure it out from? Well, you can file a motion to vacate only after you have a judgment notice. Then you can tell the court that you did not receive the summons as you had already shifted to a new place. As for now, wait until the court sends you any summons or notice.
