Collections law firm threatening to file law suit

I have been with a credit counseling agency since 2008. I have never missed a payment. However, from yesterday I am getting aggressive phone calls from a law office that says that I have to pay 200 dollars now, else they are going to file with the clerk of courts, and will get my license suspended. I have been making 50.00 payments all along which they did admit to receiving and they would not allow me to pay at another time. I just need to know why they can do all this stuff when I am currently paying on the account. There is no way I can pay 200.00 all at once. I am solely responsible for my 205.00 debt consolidation, over 800.00 a month in utilities, 250.00 a month for gas for my car, 350.00 a month for groceries and other bills that need to be paid on a monthly basis. I'm afraid that if they garnish my wages I won't be able to pay all the bills I have. What can I do?

Can you tell whether or not you have discussed this problem with your counseling agency? What you can do is make a copy of your monthly income and expenditure. If you can convince them that you really can't make more than minimum payments, the collection agency may not sue you. If they file a lawsuit, they will have to bear the initial cost of suing. Thus, if they realize that they won't be able to get more than minimum payments from you, they won't go forward with the lawsuit.

what is going on with the credit counseling agency? do they have an agreement with the creditor? I would complain to the attorney general. depending on the state you live in you can protect a portion of your wages from garnishment. If you go to court and show that you are making payments, the judge may be unwilling to to do more.
