collection agency

I have a question. I open a providian cc about 10 yrs ago, went thru a divorce and did not pay it for a year. After some income tax $ I payed it off (7 years ago) now I have a collection agency charging me. I called Providian and they dont have any records on file either by name or ss number. I have a good credit now after being really bad. What can I do?

Check the SOL for you state and see if it has past if so do not pay them anything. Because if you do it will start the SOL all over again. If it has past send them a letter letting them know the SOL has past and they can not collect from you. I would also check your credit report. Because most likely they are reporting to them as well. As far as the original debt it has probably been removed since it's been 7 years. But if not you can dispute that and have it removed.

Hi Johanna,

First of all if it the debt account is past 7 years, then you need not worry since any kind of negative item falls from your credit report after 7 years. However, to be sure you can send a debt validation letter to the collection agency asking them to validate the debt. When you ask for debt validation, you can expect the following documents to come to you:

  • Your outstanding balance and statements
    A copy of the original contract between you and the creditor
    A document stating that the collection agency is empowered to collect the debt.

Without these documents the validation is not complete.

So you want to validate the debt or try to seltte? You can't do both in one letter without confusing them..lol. Validate first, then offer to seltte. I would validate with a letter, then when it comes back yours, give them a call and make an offer. Just get it in writing before handing over the money.
