Can a collector pay for me?

The debt I have was from over 4 years ago, maybe even 7. The collectors are suing, and I am my own legal counsel scince I can do nothing else. The credit report shows that it was opened on 11/2009. So they made a payment without us knowing about it. Can they do this legally?

Hi apriljeancox,

Welcome to this community :)

No, the collection agency cannot do this legally. The CA have not made any payments. They have simply changed the last payment date, and this is known as reaging of debt. Reaging without the debtor's knowledge is considered to be illegal. You can file a complaint with the FDCPA about this.

Thanks,

Aaron

I don't think they paid for you. opening date is not the same as DOFD. date of first delinquency.

AARON..if a CA DID do this illegally, how can the 'consumer' prove it was done, by the CA? A CA can say/report anything to the CB's.

Hi sdchargers,

If the OP has proof of the last payment he will be able to prove that the collection agency did this illegally.

Thanks
