Debt was sold to a CA, my friend set up a payment after thew ole' scare tactics used by the CA worked on her she set up check by phone payments, will the processing of these payments restart the SOL on this C.C. account?
Er, Yes. Once she starts making payments she automatically restarts the time clock. The only thing I could think of having her do at this point is asking for debt validation before making any further payments. She should be sure the debt collection agency collecting the debt has the legal right to do so. I would also advise her against giving any debt collection agency her bank information. Does she relize how many times people like this take more than they actually agree on. She could look in her account one day and all the one would be gone. Nevr give banking info to a collector..arrange payments by mail..they will take it if it is the only way they can get their money.

Before agreeing to make payments on the debt, one should always ask for debt validation. I hope she has not yet started payment. If not then ask her to send a debt validation letter to the CA asking to validate the debt. Yes, once she starts paying for the debt, the SOL will be restarted. Also, I agree with Firey that one should never give bank information to the collection agencies. It is not advisable. Ask her to make another payment arrangement if the debt is valid.
