What to do?

I sent a letter to CA requesting to settle debt and remove negative info off my credit reports. They left message on my phone that they can't meet my request only thing they could do is report payment in full but could not remove the inquiry from the report. They said they will sue me to get an attorney. It was an old Chevron gas card with full balance of 1300 and they are willing to settle for 886.42. What should I do? I dont trust them(creditors interchange out of Buffalo ny) and they have a bad rep from BBB. Should I be worried about them suing me for 1300? Need to know by today thanks...

listening to the voicemail again he said a letter of satisfaction would be given to me and then i can send that to the credit buereas and have them remove it...which i find weird that that company can put it on my report but yet they cant remove it...need help have to let them know by today..thanks

You can do this. Once you pay off the debt and you get the letter of satisfaction, you can send copies of your payment receipts and the letter to the credit bureaus and request them to remove the negative item from your credit report.

If you agree to pay the CA then they won't sue you.

do you have all your credit reports?
what state are you in?
what is the original creditor(chevron) and the name of the CA?
what is the date of first delinquency? 30 days after last payment

A letter of satisfaction will not remove this.

do you live in NY state? In NY there is a law that says a paid charge off must be removed in 5 years instead of 7. if you give some details I might have more.

1.have all reports CA is listing it on Transunion
2. live in texas
3. original was Chevron but got sold to precision recovery analyt who sold it to creditors interchange according to creditors interchange letter. I had spoken to them on the phone and they where willing to settle the 1385.00 for 886.42. i sent a delete negative letter and they call me and said they couldnt. Where i messed up was i didnt send a DV letter first which I just did today.
4. Not sure I saw it for first time on credit report and it was listed 01/2010. Any advice is appreciated..thank you

TX has good consumer credit laws.

when did you stop paying Chevron? not when CA listed it on your report

the Sol in TX is 4 years. according to TX law they must respond to a DV letter no matter when you send it. Send a DV

hey Cinn I did send a DV certified letter 9-23-2010 and I just checked the tracking and they received it on 9-25-2010. Im just waiting for my green reciept to come back to me and for them to respond...How long should I wait and what are my next steps? thanks..

not sure why i was popping up as guest then i typed in drifter which i use in other sport forums by accident..lol but its still me..lol

ok, so you need to wait for a response. they are not allowed to pursue any collection activity until they respond

Hi d,

As they have received the letter, you are supposed to get back the return receipt within a few days. However, collection agencies do not always send back the receipt. As for their answer, you can wait for a month and a couple of days.
