Not yet, they purchased a debt from Arrow Financial and sent me a letter claiming they are goingto sue me. I immediatley sent a validation letter; which I know they can not validate. I have contacted another attorney for this issue and hope to hear something very soon. If not I think I will have to go to small claims court.

Hi LT,

As far as I know, if the collection agency (CA) cannot validate a debt within 30 days after receiving the debt validation letter, you are no longer liable to pay the debt. This is covered under the Fair Debt Collection Practice Act. The CA cannot sue you for a debt that they have not been able to validate. You can always dispute with the credit bureaus and get the debt account removed from your credit report.

I have found it is pointless to dispute a debt with the credit bureaus, they only require a creditor to say yes it theirs. I have in turn sent them evidence that the debt was sold to another collection company twice now, even after I request validation and disputed it with them. If this doesn't work I may have to file suit.

i have also received a letter threatning to sue me only it was to "mr. stephanie" and not to me then got a phone call from a rude lady today about it and they said it was for a master card i told them i never had one, the lady then scolded me like a child for telling her so as she was still speaking and then the lady was like did you have a loan or something? she had no idea what it was for i told her i would talk to her when they could figure out what i owed for or if it was even mine at all. im assuming that they have nothing if they don't know whether its mr or ms and think its for a master card even though i never had one ever?

Hi stephanie,

It is possible that you have received the letter from a collection agency. You must send a Debt Validation Letter to the same address from where you received the letter threatening to sue you. The collection agency should validate your debt, supporting it with the following paperwork:

1) Any proof that they have either purchased the debt or have been assigned by the creditor to collect the debt.
2) A copy of the original contract with your creditor.
3) Your past payment records for the same account that they are trying to collect.

The CA should also explain in writing, the exact amount (including the late fines if any) they are trying to collect. It should also clearly indicate their method of calculation. If the CA is unable to provide you with the papers I have mentioned above, then under the Fair Debt Collection Practices Act, you are not liable to make any payments.

This colection agency is terrible in their collection practices. Make sure you do ask them to validate the debt and tell them to only contact you via US Mail. Cease communication with themm immediately. Tell them their letter was wrong and that that is not you or your debt. Remember they are not your friends.

Gamache and Myers has filed suit against me. I called them and they were unable to give me any information on the account. The original creditor has deleted the account and stopped all collection activity. They failed to valid the debt. Do I have a claim against them if they have no proof from the original debtor. The collection company they bought the account from said Gamache and Myers asked them for docs on this account, not from the original creditor. Can they do this and should I bring it up in my defense for court. I have never gotten any paperwork from any of them. My thought is to sue all three collection companies for violation of the FDCPA. Any thoughts are helpful.

I have also been sued by Gamache & Myers for one of my credit cards. My mistake was not sending them a debt validation letter, which I did for another card they claim to have bought. Anyway, I called them to set up payment arrangements after I got the letter that said they were filing suit. Stupid me again, I had the payments coming out of my checking account monthly and I still got a summons to appear in court earlier this month. I went to court and set up the same payment arrangements and realized they were trying to double collect, so I closed my checking account and opened another one.

To all that have read and responded to this post. I have filed suit against Gamach Myers and the other two collection companies say they own this account. I did my homework and I truly have a great case. Good luck to you all and I will keep you informed.

Gamache and Myers actually filed suit against me in my county for an unpaid credit card bill of $1700. I called them and requested a settlement offer and the sent me one of $1100. I guess I will have to pay it or go to court. Any suggestions?

You can set up payments with them. I did this, but they still took me to court. They are very rude people. I have tried calling to make payments and can't get anyone to answer the phone. Then my payment is late so I am in default and they threaten me. I have dealt with other CA and never had this problem.
