Sent DV letter 3 times no response

I received a letter in the mail 7/28/09 from Cardworks Servicing offering me a settlement for a debt over 7 years old (Past SOL for my state). The original debt was $300 and their settlement offer was half of $1800.00 which they were claiming as the debt. I sent them a DV letter 8/11/09 certified mail and reieved the reciept several days later. I waited and got nor esponse so I sent a 2nd DV letter to the original address listed on the form as well as a second address I was able to find for them as well. This was on 10/09/09 that I certified mailed these. I still have heard nothing from them. What should I expect going forward. Also the debt they are claiming was originally owed to Capital One lists the current creditor as Northstar Capital Aquisitions and Cardworks Servicing as the collecter for them. The debt is not listed on any 3 of the credit reports as well just an inquiry from them on 7/24/09.

I would not worry about this debt. Number one it is well past the statute of limitations. The reason you are not see3ing it on your credit report is because after 7 years a debt "falls off". If you wanted you could send them a SOL exipiry letter. You can find sample letters of this under letters of credit to the left hand of your screen.

One thing you must remember if you make any payment on this debt you will reset the SOL.

Hi Jnni,

Before even thinking about the SOL, I would say that 7 years is the stipulated time for any negative item to fall off from your credit report. Hence, you cannot find it in any of your reports. Moreover, the debt is well past the SOL. Hence, there is no way that the creditor can do anything to collect the debt or sue you legally. If you want you can send an SOL expiry notification to the creditor letting them know the same. Also you need not bother about the inquiry listed, since it is a soft inquiry and does not hurt your report and score.

Great advice Justin and just for back up, I would file a complaint with the attorney generals office in your state if they continue to pursue the debt.

If the company hasn't responded to any of your dv letters, then they probably don't have any proof that you owe them. Send a letter to the Credit Bureaus stating that you do not have an account with that company. I did it and I was able to get mine removed. Good luck!.
