My brother has a Federal Pension from the Post office in the state of RI.
Capital One is taking him to court for a past due bill even though he offered to pay on a monthly basis.
They are threatening to attach his pension.

Can they do this?

Federal Pension is not garnishable. However, this depends on the state garnishment laws too. Thus, you need to check your state garnishment laws.

As for the payments, can I know if your brother is making atleast minimum payments? If your brother is making minimum payments, or more than minimum payments on this card, then the creditor cannot attach his funds.
