Subject: need advice!! am being sued by credit card company

I just got a citation to go to court and pay a debt I owe. I didnt know what to do so I called the court and they told me it was a credit card company suing me and now I have to write a letter to the court about the debt i owe. What am I supposed to write besides what I owe? . If I owe the debt what do I do? Do I have to go to court? I got a call from their lawyer. Should I try to settle with the lawyer or what? What options do i have? 7000 is too much for me to pay. I dont have a job now. I Need some advice. is there any way theyd let me pay less than what i owed if its from the credit card company and not a collection agency?

Hi musicfan,
Citation from court asks you to appear in court on a stipulated time and debt. If the person asked to appear fails to appear as asked by the court, he can even get punished. Thu, you can talk to the court clerk about this. Moreover, you were asked to file an answer to this. Thus, you should do that.

The court clerk will know this better. You can request the court clerk to help you in answering to the summons. You can also take help from an attorney.

You can first talk to the creditor. If he asks you you discuss this with the lawyer, you may have to try settling the debt with the lawyer. However, you should get the settlement in writing, and you should also request the creditor to stop the lawsuit on payment of the debt.

I am not sure about this. Does not the summons mention anything about the court date? It generally does. If there's no mention of the court date in the summons, you can talk to the court clerk about the date.

| I called the credit card company but they arent handling the account anymore. So it must be a collections agency suing me. the court clerk said it was a credit card company. I'm confused. Their asking for the same amount of money as the credit card company. Do I contact their lawyer now? What should I do differently? |

Hi musicfan,
As you are not sure about this debt you can visit the court and request the court clerk there to provide you with the paperwork in regards to the debt.
However, you should file the answer to the summons within the stipulated time.

| I was sued 10 years ago by my credit card company over 6,000, I didn't show up for court date, constable came out to my home and saw that I didn't have anything worth 6000 that I could sale and he wrote something on the paper and I never heard from them again |
