Subject: Old debt trying to be collected

I have a request for payment from a CA , on a debt that has expired (its 7 years old and Calif has a 4 yr SOL)- Is it better to ignore all their communication or to send a DV?
They noted on the request that if I didnt notify their office that I intend to dispute the validity in writing within 30 days, they would assume the debt as valid. I know that they cant sue me, but I don't want to reset the clock and I'd like minimal harrassment. . . |

Hi dpant00,
Do not pay on the debt because that will start the SOL all over again. You need to send the a SOL letter letting them know the SOL has past and they can not collect from you. Make sure to send it certified with receipt. So you have proof they got it. This should take care of it. Keep us posted. |

Hi Dpant,
The debt is already 7 years old. It is time that the debt falls off your report now. Paying the debt at this point of time would be unwise. You simply need to write a letter to the collection agency stating that the debt is past sol and it is also past 7 years time. Always send it through certified mail. If the CA still harasses you, then file a complaint against the CA with the FTC and the State Attorney General. _________________ All the Best
