Subject: Alias Summons in Illinois

| I received an alias summons on behalf of Discover Card. I made payment arrangements with their attorneys office but I was told it was up to me whether or not to go to the date of the summons. Should I still go? I know that they are still seeking a judgement against me. Should I still file a written appearance and answer? What shoudl my answer be since I already made the payment arrangement? |

Erkska, YES! you you definatley go. If you do not then they may get a default verdict against you and the judgement could be listed on your credit report for years to come. I would make an appearance and inform the judge that you have made payment arrangements with this company to fullfill what you owe on the debt.
If you do not go they can even have your wages attatched and this can really become a pain. I can not stress how important it is for you to go. |

Hi Erkska,
You should not miss the court date. You should file an answer stating that you have already had a talk to the company about paying the debt. If you miss the date, then Discover Card may get a default judgment against you. To avoid this you must appear in the court. In fact, once you appear in court, you can tell the judge that you have already made arrangements to pay off the debt. If you have any written proof to this statement, then you can show it to the court as well.

| If you go yo court and have already made payment arrangements with the creditor will this stop a judgment or wage garnishment from being issued? |
