Can a garnishment be done towards child support if I am only 1 month behind? I get tired of hearing the nagging ex threatening me in doing so. I pay my child support with a money order to the state of Missouri. I can not afford an attorney right now but wish that someone could provide me with the correct Missouri law answer. thank you

Hi headpains,

To garnish your wages for child support, your ex has to bring a judgment against you. If the court orders to garnish your wages, your employer will start deducting your wages. I have also heard that there are strict laws in Missouri, if you fail to pay after there is a court order. In that case the court may order to seize your property.

headpains, generally you would have to show a history of non payment or late payment before they can put in an order for garnishment. It now costs money in some states to have wages garnished and it can come off the amount your ex actually recieves so she may not want to push this issue if you are only late a few times a year.
My hubby pays support and his is garnished due to his not paying much in his younger years. He is a few months from getting done with it. The reason I tell you this is because you should be sure to make prompt payemnts. Once they start garnishing they usually will not stop garnishing even after years of paying on time.
It can become a real pain when getting new employment, unemployment and lots of other things. So it is best just to pay it on time and forget it.

Wow where I'm from they will take their drivers licenses and put them in jail. I know you need the money now. But do you know the kids can take them to court and collect the money when they are older. My ex use to do the same thing. But when I took him back to court it cost him more each month. So after about three times he finally learned that he had a responsibility and he would pay or it was going to get pretty expensive. Now he pays on time every month.
