Can CA garnish my husbands wages for my debts?

My husband and I received court orders for medical bills that are mine. I was on a payment plan and have paid regularly as agreed, before they served us with court orders. They also talked to my husband about my personal medical bills without my permission. I want his name off the judgment. I called the collection agency and they said that they can even garnish his wages of my debts. Is this true? What should be my plan of action?

Hi Davis,

I don't think a collection agency can garnish your husband's wages, to pay off your personal debts. Collection agencies often use these tactics to get you to pay. Your husband is not responsible for your debts, unless he has agreed to be a co-signer. I think you should file an answer to the summons, and request the court to remove your husband's name from the judgment.

Hi Davis,

In case the collection agency is successful in getting a garnishment order against you, do not give them access to any joint account, you have with your husband. You should try to set up a payment plan with them, and pay off your debts.
