Can self employed persons have there income garnished ?

Since self employed person do not have a permanent source of income, their wage cannot be garnished. So the creditor can bring judgment against you to garnish your bank account. If the creditor brings judgment against you to garnish your account, then whenever there is any money gets credited in your account, it will be withdrawn by the bank and deposited with the creditor and this process of garnishment will continue till the time the debt is repaid in full.

Can a bank acccount be garnished if it is a joint account with a person not on the creditors hit list. My name is not on the garnishment but my check gets deposited in our account.

Hi Alice,

If the creditor has any knowledge about the joint account then yes, the account can get garnished. I think it is always better to open a new account in your name only in such situations.
