There can be any number of judgments that can be brought by creditors, but the maximum amount that can be garnished from your wage should not exceed 25% of your wage. This 25% wage garnishment is the maximum limit upto which your wage can be garnished no matter how many judgments are brought against you. Moreover, if you are the head of the family, not more than 10% of your wage can be garnished.

Yes, Missouri laws allow only 25% of the wage to be garnished. However, if it is for child support or alimony obligation, the garnishment may be higher. Moreover, this limitation on the maximum amount of garnishment do not apply if it is for bank account garnishment, where your bank account can be garnished whenever any money gets credited in your account and this process will continue till the debt is repaid in full.

A family member went throught chil support garnishment. They can take a lot. Here is what I found from reading those papers:
The Consumer Credit Protection Act (15 U.S.C. ยง 1673) limits the amount that can be deducted as child support/alimony from earnings. The limit ranges from 50 percent (50%) of disposable earnings to sixty-five percent (65%). The full ordered amount of child support/alimony will be deducted as long as that amount does not exceed the maximum percentage allowable.

Can a creditor freeze your bank account in Missouri if there another person on the account who is not listed on the debt?(ie anew spouse)

Hi deezrog,

In Missouri the creditors have the right to garnish your joint account, if they have garnishment order against you. To avoid it your spouse should create a different account, preferably in a different bank. She should transfer all her money and pay checks to the new account.

I recently had a credit card company clean out all my bank accounts. The money in them consisted of unemployment, child support, and a student loan payed out to me. They have a judgement against me for an amount less than what they took. Can they take every cent I have? My ex is (understandably) unhappy because they took all of the child support money, leaving me with no way to feed them or take care of them. Is there anything I can do?

You can go to your bank and show them what the judgement was for and show them they took an excess amount. Probaly the best bet though would be to contact the courthouse, atty general or FTC.
I know these funds were set aside for a purpose but once a creditor gets a garnishment they are legally entitled to attach bank accounts regardless of where the money came from (unless you can prove the funds where from Social security). Once funds get deposited they become fair game. What should not be allowed is for them to take more than what the judgement was for. Try the steps above. My first call would be to the courthouse.

Thanks for your advice. They can take umemployment, too? I thought that fell into the category of exempt ...

Unemployment benefits cannot be garnished under normal circumstances. However, if they are deposited in a savings account that is being garnished then the benefits will go away along with all the other money in the account.

Subject: what are my options now, Missouri bank levy in effect

an old cc bill went thru court with a default judgement and the court put a bank levy on my joint account. Ideally I'd prefer to set up payments with the original creditor, but they seem no longer interested in other terms now that the levy is in effect. Can I petition the court in any way or am I just stuck with the bank levy?

My husband received a garnishment order from the "State of Ca Franchise Tax Board. Being that he is a seasonal firefighter, can they garnish his unemployment benefits once he is off season?

My husband is receiving unemployment benefits, it is the only income that we have at the time, can this be taken from our bank account through garnishment?
Is there a form that can be filed if so where and with whom.
