how many garnishment can be payed out at a time in Missouri

There can be any number of judgments that can be brought by creditors, but the maximum amount that can be garnished from your wage should not exceed 25% of your wage. This 25% wage garnishment is the maximum limit upto which your wage can be garnished no matter how many judgments are brought against you. Moreover, if you are the head of the family, not more than 10% of your wage can be garnished.

Yes, Missouri laws allow only 25% of the wage to be garnished. However, if it is for child support or alimony obligation, the garnishment may be higher. Moreover, this limitation on the maximum amount of garnishment do not apply if it is for bank account garnishment, where your bank account can be garnished whenever any money gets credited in your account and this process will continue till the debt is repaid in full.

A family member went throught chil support garnishment. They can take a lot. Here is what I found from reading those papers:
The Consumer Credit Protection Act (15 U.S.C. § 1673) limits the amount that can be deducted as child support/alimony from earnings. The limit ranges from 50 percent (50%) of disposable earnings to sixty-five percent (65%). The full ordered amount of child support/alimony will be deducted as long as that amount does not exceed the maximum percentage allowable.

Hi deezrog,

In Missouri the creditors have the right to garnish your joint account, if they have garnishment order against you. To avoid it your spouse should create a different account, preferably in a different bank. She should transfer all her money and pay checks to the new account.

I recently had a credit card company clean out all my bank accounts. The money in them consisted of unemployment, child support, and a student loan payed out to me. They have a judgement against me for an amount less than what they took. Can they take every cent I have? My ex is (understandably) unhappy because they took all of the child support money, leaving me with no way to feed them or take care of them. Is there anything I can do?

You can go to your bank and show them what the judgement was for and show them they took an excess amount. Probaly the best bet though would be to contact the courthouse, atty general or FTC.
I know these funds were set aside for a purpose but once a creditor gets a garnishment they are legally entitled to attach bank accounts regardless of where the money came from (unless you can prove the funds where from Social security). Once funds get deposited they become fair game. What should not be allowed is for them to take more than what the judgement was for. Try the steps above. My first call would be to the courthouse.

Unemployment benefits cannot be garnished under normal circumstances. However, if they are deposited in a savings account that is being garnished then the benefits will go away along with all the other money in the account.

an old cc bill went thru court with a default judgement and the court put a bank levy on my joint account. Ideally I'd prefer to set up payments with the original creditor, but they seem no longer interested in other terms now that the levy is in effect. Can I petition the court in any way or am I just stuck with the bank levy?

Hello,

I live in MO. and I was just wondering if once a judgement has been put against you and you receive your taxes at the first of the year can the debtor take that from you also? I do know that they can on a government loan but I just had a judgement on me from a loan company thats not government.

I am on disibility and my husband on unemployment we are going to be sued for24,000 dollar medical bill.I have many other debts for additional 10,000 dollars. Iknow they will win a judgement against me can they collect on disability and unemployment. I already removed all direct deposits to the bank.I contacted a laywer and feel pressured to go bankrupt but I have to save money to go bankrupt which will take several months

Hi Chico,

Generally speaking, unemployment and disability benefits are non-garnishable. However, garnishment laws vary from state to state. Thus, you can check the garnishment laws of your state.

As you can't pay the outstanding debt amount, you can request the creditor to agree to a settlement. Settlement lowers the outstanding debt amount by 40-60%.

My unemployment benefit check is deposited into my checking account my account is now frozen because of a judgement aganist me for an outstanding loan. Can they garnishment my unemployment check this is the only income that I have ? I did not have enough in my account for the full amount of the judgement so they everything and now I have a negative balance. I live in Missouri but am out of state due to my moms health at this time so now the my account is negative the bank is charging me fee's because of my account being negative. Thanks for your help.

Generally speaking unemployment benefit cannot be garnished under the rules of Federal Law. However, it can be garnished for alimony and child support purposes. Can you tell me who is garnishing your account?

Hi Brenda:

You should first notify your bank that your money comes from Social Security Income. Also declare this to American General Finance. If still the garnishment continues, you can complain about this to Federal Trade Commission.

Rob:

Can you tell whether or not you want to know about the amount you have paid in garnishment? If yes, then you will have to ask the bank to provide you with the bank statements. However, you should also know this that a creditor cannot garnish more than allowed by the court. The court sets the amount that is to be garnished. If not set, then atleast 25% of your wage may get garnished.

Missouri Student Loan can garnish any percentage they want even if you file Head of Household. They took 38% out of my checks and there was nothing I could do.
