| my wife and I are both on Social Security disablty the credit card companys filed a lawsuit againest us do we have a chase I know they can not guaruish our S S right. |

| I'm on permanent disability now, but the employer's insurer is demanding $108,000 to pay them back for what they say I "owe" them. They never even paid me that much!!!! But they will not negotiate in good faith with my lawyer, and I have to pay over $1000 each month in legal fees. They just keep insisting they want $108,000 and they are now threatening to ruin my credit rating. CAN THEY TAKE MY 401k??????? |

No, money coming from your retirement cannot be garnished. Still, you need to check the state laws on garnishment.
Barb:
If you can't make your credit card payments, the creditors can sue you, and garnish your bank accounts. They can also put lien against your property. Your children may not be held responsible for paying your debts, but if lien is placed on your property, and you hand that over to your children, they will have to deal with it.
Jimmy:
No, they will not be able to garnish your Social Security income. However, you will have to notify your bank, and your creditors about this. You can try debt settlement to pay off the debt. This lowers the outstanding debt amount by 40-60%. The only way in which you can stop the lawsuit is by paying off the dues.

Can I know whether or not this 401k is from retirement and Social Security? If it is, then they will not be able to take it. However, for that you will have to notify your bank and creditors about that. Else, they may be able to take the money.

| I have an outstanding credi card balance of $22,000. My payments are $425.00 monthly. Recently I realized that I can no longer pay them. I am buying my home, however the balance is $107,000. I contacted a credit counciling service, and they advised me to just quit paying the credit card. They told me there was nothing they could do to hurt me. I have no job, live on Social Security, have no other income, have no car and my Social Security just won't stretch far enough to make those payments. What would be best action to take. |

A unsecured debt has been defaulted, debt collector has not
phoned or written me at all going on over 6weeks.
Can they automatically sue me and garnish my military
retirement check going into my checking account and that
is the only income I receive? |

due to a soft heart and complete ignorance I signed a loan for my daughter to purchase a new car. she can no longer make payments.
we own nothing except one paid for car in my wife's name and live in a small retirement community. we have a joint checking account and our only income is from social security and company retirement. I plan to turn this car over to the lender as we cannot afford additional payments. can these funds or our bank accounts be attached and if so, do I need only one account in my wife's name. |

| My parents owed money fron credit cards from 2007, I tried to pay most of them but there was one which refused to give me the total so I did not pay. them, my parents live off SS benefits and has no properties, they currently live with me so they can get back on their feet slowly, a judgment against them was entered and the bank garnished their money which was money directly deposited from SS which I thought is not allowed, the bank refuses to return the money what can I do. ? We live in the state of Colorado |

| I keep reading here that other than federal taxes, alimony, and child support that ss benefits can't be touched. My 78 yr old sister and her husband had a USDA rural development mortgage, he passed away two years ago and she could not make the payments. She tried to sell the property but could not find anyone who qualified. Now, they notified her that they will be taking 15% of her ss benefits starting in September. Is this legal? |

Hello,
My mother recently received a summons for a judgement. It was filed on June 14th but she received it last week. It sates that she has 30 days to respond. How do we now what date to go by since it says 30 days once you receive it?
Should my mother respond? My mom only receives SSI and does not have assets or owns anything. She is stressed out and does not know if she should contact the creditors to arrange payment. Actually she is really limited. This is state of California. Which form would she fill out if needed?

Hi Daena,
The 30 days will start form the day after which the summons was served. Yes, your mother should respond to the summons. Else, the creditor will win a default judgment against your mother. However, after answering to the summons she can contact the creditors, and work out a settlement. She should get the settlement agreements in writing, stating that the lawsuit will be stopped.
You will get the answer forms from the Internet, and also the court clerk.

| My husband was out of work, he finally got a temp job in Idaho, he is due for court regarding credit card can I go in his place, we cant afford for him to fly back and loose pay also the credit card wrote us a letter stating they would accept 3,200 we owe 4,100 can I just go to clerk of court and file that? |
