Can AAFES garnish Military Retirement?

hello, DAS. I'm in the Military, myself. I know to get a Pension from the Military, (I beleive?) you have to be 59-60 years old to get it. However.....with AAFES taking something from that Pension,....I think they can. I know they can't take money from SSDI, etc. But, I DO think the Military can take money out of it's 'own' supply. If this makes sense.

Hi daszhnit,

Yes, Army and Air Force Exchange Service (AAEFS) can garnish your military pay, and as well as the military retirement pay. They have an affiliation with the military, and thus as far as I know, they have the power to garnish your retirement pay.

Thanks,

Aaron

AARON,.....one of the members had just PMed me and told me that garnishment CANNOT be taken from your Military pension. I didin't think it could.

We are in the process of filing chapter 7. Our lawyer gave us notice to NOT stop making payments on the star card until they tell us it is safe to. Otherwise my husband's retirement pay can be garnished without prior notice should we stop paying voluntarily.

Hi sdcgargers:

If you owe money to a government institution then your military pension can get garnished. Army and Air Force Exchange Service is considered to be a government affiliated service. So, as far as I understand they have the right to garnish the military pension. This will fall under the exceptions regarding Social Security, and pension garnishment.

No, you should never stop making payments on the account. The lawyer has advised you rightly.

Thanks,

Aaron
