Subject: Credit Card Judgement

I have a CA judgement against me that stemed for a $3000 credit card. The judgement was made in Aug2008 and I guess I screwed up and let them get a default judgement (I thought I was going to get paperwork for a court date, but never did). Anyhow I recieved notice today that they are garnishing my wages and that the judgement was for $7k with an additional $800 in interest since then.

I know I can call and see if they will reduce the garnishment amount but is there any way to get them to reduce the judgement amount at this point or am I just out of luck?

I have been paying off all my debt the last 2 years, they just got a judgement before I could pay off their amount as the debt settlement company I have been working with settles from lowest to highest.

I believe I would talk to who ever is handling your debt settlement and see what they can do. Because I'm not 100% sure but I think after they get the judgment approved by the court. I don't think there is anything you can do except pay it. I know it stays on your report for 7 years. Others should be by to help you with this later.

Thanks for the response! The paperwork I got says I can contact a lawyer but that just screams more money to me.

Hi, my wife had credit card debt before we got married. We can't pay it and it is going to become a judgment. We lost our house, own an old cheap car and have no assets anymore to be recovered. Can anyone garnish my wages as her husband for this amount?

Thanks!

I just finished a service plan with MyCreditEdit.com. The plan was for 24 hour credit repair service. I just got most of my results back, and their service was able to delete 4 out of the 5 negative items. The remaining item is a judgment from 09/2009. They are still working on it, however. What can be done?

My husband recieved a judgement or complaint from a law firm for a sears card that he had applied for years ago and fell behind on the minimun each month due to being ill and having limited income. The law firm contacted him by phone at his job and left a message for himto call them. after he got off work he retuned the call and they wanted payment he explained that he had health problems and could not pay the amount they asked. So he arranged to pay 25.00 amonth but they did not tell him where to make payments so he sent them to the original collection agency that sold the account . tham a month and a half latter the constable delivers judgement papers .What are his options?

Subject: what can credit card collectors take in a judgement?

Can a credit card company get a judgement and would my home or homes, SS, Disabilty Ins pmts, cars or bank accounts be attached? Should I have automatic deductions stopped on my accounts so money isn't automatically deposited? I am on disability and disability ins thru my past work. My husband gets VA disability and no pay check, but monies that get deposited go out automatically for bills.

Have an attorney threating letter.

Are there any exceptions in the state of PA when a creditor can garnish wages on a credit card judgement?

Garnishment of wages in PA occurs under limited circumstances like:

  • Judgment for child support or for spousal support
  • Back rent on a lease for a residence
  • Certain types of taxes
  • Final divorce obligations
  • PHEAA student loan

Garnishment can be done only by a court order which, cannot be issued without a notice to the debtor.

In Pennsylvania, your wages are normally exempt from garnishment and can occur only under special circumstances but any bank account can be garnished if there has been a judgment against you in law court and if you deposit your wages in that account, they may be taken away

I have received a judgement last week but I'm also filing bankruptcy which will be complete this week per my attorney. Will the bankruptcy still protect me from the garnishing procedures?
