I live in Idaho. I incurred a Credit Card debt in 2004.

I had to quit my job to take care of my disabled son. I am 80 and have no income except SS. Credit card companies are called me threatening to have a judgement placed against me. I have no assets, live with my sister and her husband. What can they do.?????

They cannot do much, since you do nto have any asset

Make sure to informa th bank that the amoutn you are receiving in the accoutn is socail security, so if the collection comepny wants to take money out of your savings accoutn then they will not be able to do that

Hi Jolene,

I understand your situation. Do not be depressed. Even if you have defaulted credit card account, the creditor will not be able to do much since you do not have any assets. Moreover, your debt has already crossed the Statute of Limitations, which is 4 years for such accounts in Idaho. Therefore, the creditor cannot sue you anymore.

You said that your only source of income is Social Security benefits(SS) right. So then, the creditor cannot garnish income coming from SS. Hence, rest assured that the creditor cannot do anything against you.

Can they still serve me???? One company did serve me with a summons to appear in court. I called and explained why I didn't have anything I could say and therefore the judgement was placed against me. Don't want that to happen again What should I do.????

Joy, You hould have appeared at the court hearing. Once the judge seen what your income is then he would have not issued the judgement. You could try to revoke the judgement but I am not sire if it would be too late to do that.
If any other creditors take you to court please besure to go to the hearing. This is always in your best int5erest , even if you owe the debt. It is your chance to be heard and explain. If not they will win automatically by default.

Does this mean your only source of income is also the SS benefits? If yes, then they cannot get a judgment against you. If this is not the case, then a creditor can bring judgment against you. After you get a summons from the court, always make it a point to appear in court, otherwise the creditor will get a default judgment against you.

You can also negotiate with the credit company regarding the amount you can pay and settle your debt with their consent. However, if you wish to avoid any such situation, pay your debts on time.
