I was sued by a credit card company. There was a jugdement against me. When I pulled up the record it says the case was voluntarily dismissed. Does this mean that there is no judgement against me?

HI Ifactorb,

Yes, definitely. If your report states that the case had been dismissed, then you do not have that judgment against you anymore. But still if you have confusion regarding the listing, then you can call the creditor and clarify it.

why would a company voluntarily dismiss a judgment? Its good that they did, I am just amazed. If its sure money in there pocket its hard to see them cough it up. I would be glad.

I am not sure that I would wake an old dog, I would probably leave it alone, it does say dismissed and that is what the potential creditors see.

You can make your own decision. How long will this stay on your report. Is there anyway to have it remove from your report since it is dismissed? Maybe take that angle and leave the creditor end of it alone.

Nothing surprises me anymore when it comes to a credit card company after what I have been through with them.

The thing is it never showed up on my credit report. I am just going by the court document. I was checking to see if it was on my credit report and since it wasn't. I searched the public records and found the case. We had a judgment and then they went for a Writ of Garnishment. I am guessing since I am not working and there is never money in our account (which is also in my husbands name) they couldn't garnish anything. They then dismissed it. When they did sue it was about 3 months before the statue of limitations expired. My next question is since the SOL is now up can they still come back and sue me again? The crazy thing is the original debt was $800. I was pregnant at the time and put on bed rest and was having financial difficulties. I was willing to set up payments but they would not lower it less then $200, and wanted me to send 4 post dated checks, which I couldn't afford at the time and wasn't comfortable doing. So they sued me 3 yrs later and the total was now $3700.

Since the SOL is up they can no longer collect from you. If for some reason in the future they try to. Send them a letter stating the SOL is up and they can not collect from you. This should take care of it.

I had a judgement against me but it was dismissed because I had no money to pay them. Now I am selling my house and I will make a little profit can they come back and request the amount that was dismissed
