:shock:

I live in Washington state and out here we call workers comp by the name of Labor and Industry;

i would like to know if these funds as they are because i can't work because of an on the job injury, and will never return be guarnished for payment of a debt.

I'm 60 years old, and don't care about a credit score anymore, I am in the process of giving the house back, so i will become a rentor,

However this company of Sutter and Hammer of Bellvue,WA. even after i filed a court doc, showing I only had disability income, did manage to get a judgement for said same and a supeiona was issued so as they want more infomation about me, and want to look into employment security so forth and so on, I do not have any bank accounts.

What is best to do, i would fell better if I could find a Washington State WAC for non-garishment of said same, but I keep running into web site that put it under wages and 25% can be attached at least from the L&I can this be true???????????????????

Please help. thank you
OHNO

Are you doing a reverse mortgage? they will come after money from that. Are you in a union? I think that this income is protected but you may need to assert that. If you are transferring title of the house they may put a lien against and force it to be settled at that time.

Hi Ohno,

Any kind of social security cannot be garnished. thus, your disability income cannot be garnished too. However as cinnamngrl has said, you need to assert that your only income comes from disability. You can consult a lawyer for this. Sometimes, consulting a lawyer can be free.

So,..the fall had nothing to do with your accident at work? Is that what I understand? Why do you have a hospital bill? I don't think the hospital can take your workers comp check, but,..can you explain the work accident and why you have a hospiatl bill? Just trying to gt a 'clear picture' on this.

Go to the bank with florida statute 440.22 and demand your award. bring your settlement agreement and the law
also call the bill collector and notify them of the law.

if that dont work get a,wc lawyer to straighten it out.they are breaking the law.

depends on your state see statute 440.22 assuming you are in florida. most states say hands off workers comp . there was a interesting case in florida were a hospital garnish a fellows wc the florida supreme court ruled that no matter were you deposit the funds the can not lose thier exempt status so long as you can identify tbem as workers comp. hopes this helps im not a lawyer but its true
