My dad only has source of income is his social security benefit. He has a credit card debt of about $30,000 which he cannot afford to pay right now and he stop paying them. But some how the credit card freezing his bank account. He can not take out any money from his bank account until he has to deal with his credit card company. How can he get out of this situation. Can the credit card company bring judgment against him and garnish his social security benefit.
Please advise!!!! |

Hi Tucker
SS benefits cannot be garnished unless for specific reasons. However, if your SS benefits get deposited into your savings account, then it might be garnished. You either need to inform the bank that this money is from Social Security or make arrangements to get the money deposited elsewhere.
A letter to the bank stating that the money deposited in the account is from Social Security should stop the money from being garnished. _________________ Keep in touch

Hi A.L. Tucker,
Like Carol said social security benefits cannot be garnished by creditors. If your dad's savings and SS accounts are the same, then try to separate them. Many a times mingling of accounts results in the loss of money through garnishment. To avoid this, separate the accounts ASAP. _________________ All the Best
