I live in CO and my husband had a judgement for a debt and this creditor wiped our bank account clean. My question is that my name is on bank account and this judgement debt is not mine. My name is no where on this debt or judgement? Can they do that?

Hi thedowellsinco,

Welcome to this community :)

Can you tell whether or not the bank wiped your account clean after the judgment? What was the judgment order ? If the money was withdrawn before the judgment order, you can file a lawsuit against the company.

Colorado is not a community property state. Thus, your bank account cannot be garnished (if there is a garnishment order) for the debt incurred by your husband. However, if yours' is a joint bank account, then the creditor can withdraw money from your account after a judgment.

Hope this helps.

Regards,

Aaron
