Judgment: Creditors calling to recover the debt.

The creditor called me up and said that they have a judgment against me and has asked to repay back the debt in a week's time else they will garnish my wage, What to do now? I am not sure of the judgment.

Ask them to show proof of the judement. Also you will want to look on your credit report and see if there is anything listed there. Is this debt in the same area that you reside now? If you want a quick answer you can go down to the courthouse and ask them. They will look and see if there is a judgement out there against you. I would want to klnow for sure before paying any type of money to them. Can you tell us how old this debt is and if it is with a debt collector or the original creditor? Chances are if they had a judgement they would have been garnishing your wages and bank accounts by now..unless they just got it but that takes serving you a summons , taking you to court and a judge putting the judgement against you.

First pull out your credit report from the three credit bureaus to check whether the judgment is listed there. If you find the judgment, you need to visit the court which is listed as "court of record" against the judgment. You can take a certified copy of the judgment from the court to check whether any judgment actually exist or not. If there is a judgment, you can file a motion to vacate the judgment if the you do not agree with it.

If you can get the judgment verified and you are sure that you owe the debt, you can file a motion with the court to work out for an installment repayment plan. However, you can also file a motion to vacate a judgment if you are sure that you need not pay the debt either because the SOL on the debt has expired or the creditor will not be able to validate the debt properly.

I just pulled my credit report, and found that I have 2 judgements on me in 2008 and 2009. I believe that this was a fraduleant case, as I didn't have any debt back then. What can I do?
