Hi - I am in NY and I have had a judgement against me from a creditor for 2 years. I have not had a bank acoount because of this. The last one I had they garnished the funds. I now have an account but my mother's name is on it as well. Will they be able to take the funds from my new bank account if I share it with my mom?

Hi Mysticalnyc,

Joint accounts can be garnished by the creditor, since you also contribute to that account. Has the debt been repaid after garnishment? If yes, then there is no reason for garnishment. If no, then the creditor can garnish your bank account, by putting a levy on it. However, to be able to do this, the creditor will have to get another order from the court attaching the bank account.

Yes they can garnish this account, please be careful that you don't put your mothers household finances in jeapordy, You don't need that added stress.
