Subject: I just found out that a levy has been put on my checking acc

the levy has already been put against my checking account and my next S.S. deposit will be on the 3rd of March. How can I stop the bank from taking my money and paying the credit card company?

Hi Mea,

Social Security Income can neither be levied nor garnished. However, a bank cannot know that you deposit social security income in your account. Moreover, a credit card company wants to collect money, so they don't care where your income comes from.

However, if the account contains only social security, and you can prove that, they may not be able to levy your account. One thing that you can check is your state laws regarding social security and levy or garnishment. Another thing that you can do is, open a new account and deposit the social security income into it.

mea, since the date is fast approaching you should contact your banks manager and tell them this is Social security benefits and they can not be legally attached. Also call your states atty general and get him or her to help you with this. The sooner you call the better. Your atty general is a good source because they can get things moving fast with just a few calls. I would try to call there first.

That is always the best route to go. Visiting in person to take care of the problem usually yeilds better results. Also there may be papers you need to sign. I am not positive on that part but if it is close why not make it easier with a visit.
