Subject: Agreed Judement/ Rule 11

i was summon to respone in writing within ten days in regards to a pass debt and spoke to the representing attoney of the debt and was told that they would work out a payment of a 100 dollars a month to pay off the debt and attoney fees, i just want to begin to put this situaition behind me but feel like i need some advice before i sign anything

Hi Gigem,

Before you can sign any papers, first check into all the details of the debt and the judgment. Check the papers you are going to sign. Under rule 11 all the paper works are required to be signed by the attorney. So check into that. Other than this, if you are comfortable with the payment process you can go ahead and sign the agreement. However you should retain all the copies of the agreement.

Did you have a court date? is there a docket number? Did they file a case or are they just scaring you? Did you DV this debt? Is there any way you can pay a lump sum settlement. Payment plans are very expensive in the long run.

Has anyone heard if its true that if you go to court for a payday loan debt and they are awarded judgement can they garnish ones wages in Texas

Hi gigem,

As far as I know, wage garnishment is possible with judgment for pay day loan too.

I have seen on here where people have entered into agreements only to find that they end up paying more than the agreement stipulated.

Make sure that you have it all in writing, including all fees, intrest, etc. Make sure that you read the fine print so you don't get screwed in the long run.
