CAN A CREDIT COMPANY TAKE MONEY OUT OF A CHECKING ACCOUNT IF MY NAME IS SECOND? (BECAUSE I HAVE A JUDGEMENT AGAINST ME)

Hi Babs,

Yes, the creditor can garnish your checking account even if you are second. If the creditor has a judgment against you, then he can definitely garnish your checking account. There is only one way of avoiding the garnishment. You have to prove that the other party who is primary to this account contributes all the money. Otherwise the creditor can attach this checking account.
