We live in a border town in Texas, we purchased a car and had full coverage plus 25 miles into Mx as we travel along the border frequently. While visitnig relatives in Mx the car was stolen and the insurance refused to pay stating that it only covered accidents. They never notified the bank on any of the situation and now they want to place a judgment against us. What will happen? Can they garnish our wages or income tax returns?

what happened to the car? Was it recovered? Did you ever get it back? Was it damaged when you got it back? I am curious to know if you got it back or not?

Did you file a police report?

Can I know whether you had reported about this theft to the police? If yes, do you have the police report number? Another thing is that, did your auto insurance include comprehensive auto coverage? Not all insurances provide the comprehensive auto coverage.

Comprehensive auto coverage is that in which the insurance company provides you for losses like theft, flood, vandalism, etc.

As for the payments, and the judgment, you can first talk to them about the payments. You can stop the judgment only by making the payments. So, request them to agree to a payment plan. Get this payment agreement in writing. If they bring a judgment against you, they can garnish your wage, or your income tax return. However, garnishment laws vary by state laws. So, you need to know your state garnishment laws.

Hi. My husband just received a letter in the mail yesterday about a judgement that was issued by Discover for almost $8,000. This is the first time we have heard about this debt in at least 4 years (since we have been together). He said that the credit limit on his card was about $4,000.00. There was no letters or anything before that. My husband is a police officer and for the past few years, we have been trying to fix his credit paying off credit cards as we got our tax refunds and also made monthly payments to creditors for the settlement. But in June of this year, he was injured on the job and has been out of work since on worker's compensation. We get about half of his pay every two weeks because his court time and other special details are not included in his hourly 40 hour work week pay. I am the one that has to handle this matter and I don't know who to talk to. With his pay cut, we are having a tough time paying bills let alone trying to come up with the money for a lawyer. Any suggestions?

Also. If they do garnish his wages, do my wages get included in his income? Will they take all of his money and leave my money to take care of the household bills? since he doesn't make much money, will they take some of my pay to compensate for it? Sorry I have so many questions, I am just clueless in this area
