I live in the state of Florida and have been sent a letter saying that they are trying to get a judgement against me for credit card debt. How do I handle this? First there was a summons which I sent a letter saying that I dispute the charges and total and asked for proof. I sent that to the lawyer and court house. I got papers in the mail asking me to fill out saying that I admit to the charges...all payments made and so on. I did not answer them. Now they sent papers saying they are going after a judgement against me. The card says it's in my name only. I am married and have no job. Everything is in mine and my husbands name jointly. What can they do to me? Can anyone please help me with this? Thank you so much, Cindy Bordsen

Hi Guest,

Can you tell whether or not you have written proof that you've disputed the charges? If you have, you can use that to dismiss this lawsuit. You can also consult a lawyer regarding this.

Thanks,

Aaron

I have a copy of the letter I sent to them. Is that good enough? Or should I send another one by certified mail? Thank you

Hi Cindy,

No that is not proof enough. It will be better that you can show some certified proof.

Thanks,

Aaron

Go to the court house for the court date. ask for discovery. This would be evidence that the charges are yours

when I wrote that I dispute the charges I also sent a copy to the court house. So that should be proof that I sent them right? they had sent me papers to admit to the debt and to put down all dates and amounts that I paid on the account but I never filled them out and sent them back. The lawyer sent these to me for the other side not the court house. Will I be in trouble for not filling them out? Thank you for all your help.

Hi,

Can you tell whether or not all these statements were sent along with the summons?

Thanks,

Aaron
