served summons without case number

Hi,

I was served with summons for a credit card debt. So I checked my credit report, and the account that I have with this company doesn't match with the credit card number on the summons. However, I have decided to form my answer and also a sworn denial. As I was preparing my answer, I noticed that I didn't have the case number. So I called the clerk of the court and she informed me that there is no case number. I told her that I had a court date of April 14 at 2:00 pm. She said that there was nothing on the docket.

What should I do?

What you can do is send the collection agency a "debt validation letter". You will get a sample validation letter at http://www.creditmagic.org/repair/sampleletter-debtvalidation.html .

Probably the collection agency won't be able to validate your debt. Send the letter through certified mail, requesting a return receipt. With this you will be able to retain the proof of the letter sent by you. You can later use this to dispute the item off your report. If the agency doesn't validate the debt, but continue to report this item, you can file a compliant with the Federal Trading Commission and also the State Attorney General.

it means that they haven't filed the case yet. This is not unusual but DV immediately!!!!! this will stop them from filing until they respond the DV
