I just got a call from these guys last week after they were trying to tell me I had to pay a debt that's nearly 9 years old. I told him that I thought it was a scam and for him to send me a letter. Well the letter came today in the mail. It basically says what he told me over the phone. So after searching this company online, I find this website. It's probably a good idea that I put my 2 cents here as well so that anyone dealing with this company will know what they're up to. I searched them in the BBB and they are ranked with an F and have 39 complaints filed against them.

Anyway, I found it odd right off the bat that he said I owed on an account that was that old? I checked my credit report (all 3) and have 0 negative accounts shown in any of them. I was negative on the account in question, but I remember taking care of that years and years ago. Anyway, when he calls me back, i'm going to record everything he tells me and try to get all the info I can from him. We shall see what happens. I feel sorry for anyone this person calls and scares into paying them money. He told me that if I didn't pay the money I "owed", they would attach their fee of $1000 to debt and proceed with court actions. After reading the BBB rules on how debt collection agencies can act, this is clearly a violation on their part. Next time he calls.. My phone will record the conversation. BUSTED!

First of all, the debt has been 9 years old and the SOL on the debt must have expired. Moreover the seven year listing period has also expired and so I think that you should not pay them any amount because if you pay them even a small amount, you account will re-age and you may become liable to pay back the entire outstanding debt.

However, you should first check the SOL in your state because the SOL varies from 3 years to 15 years depending on the type of debt and the state where you have signed the loan agreement. Now, if the debt is past SOL, you need not worry else you should go for debt validation by certified mail.

kingman cole and associates is the worst collection agency, one of my friend have very bad experience of it they called him and threatened that if the debt not paid they ll put behind him behind the bar.They continusly calls thoushands times in a day.they also threaten him that they will seize his bank account, if you confront them then you are gone they are very rude kind of people.this people are the big liar they use all the criminal tactics to collect the debt i think we should stand together and take some action against them.

Trust me, they will not push me around. I want to catch them in the act of something illegal so I can forward the info to all of you and the authorities. The debt I owed to the company in question nearly 9 years ago is wiped clean from all my credit reports. As mentioned, maybe it's still active some how? I'm just curious how Kingman may have found it? It was too long ago to remember if I paid it off totally, but what I believe happened with it was it was a charge off or what ever they call it. Meaning I got a letter stating if you pay like 25% of the debt, we'll just call it a wash, drop it, but your credit report will hurt for a while till its gone.

I'm thinking these guys pulled up old records some how of old bank charge off's and are trying to get me to pay something that was settled a long time ago? He brought up the credit crisis and told me that banks are starting to pursue old accounts more closely and yada yada.... We shall see.

Can you tell me the state where the loan agreement was signed and the date of your last payment (if you have it in your records)? Normally, the SOL on the debt expires after such a long period of time and you need not make any payment towards the debt if the SOL has expired. Even if they ask you to make a payment of 25% of the outstanding debt, you should not make any payment because if you make any payment, the SOL will restart and the creditor might sue you to recover the entire debt.

Ok. Formal complaint filed against this guy after he threatened me on the phone. Here is the complaint I filed with my local police and the FTC. Complaints are being filed with my local AG as well as the NY AG as well.

This is the complaint I filed electronically.

This complaint is to notify whom it may concern that Mr. Jennings has called me a hand full of times over the last 2 weeks to tell me I owe $497.52 on a Fred Meyer account that doesn't appear on my credit report. All three of my credit reports are flawless and show 0 negative comments on them. He claimed that if I did not pay him the $497.52, he would send a local sheriff to my door to notify me i'm being sued for $1500 for which they would take the money from my pay check. He said because of the country's credit problems, Fred Meyer was seeking to claim a past debt. I asked him if I could call Fred Meyer directly to make the payment and he said no because it is illegal for them to talk to me since Kingman Cole holds the account now. After doing a search on the BBB and Google, I see that this company is VERY well known for scare tactic phone calls and it's recommended to file a complaint with every agency possible to get these guys to stop using illegal methods of scaring people into paying them. I have not sent Mr. Jennings any money what so ever.

I hope anyone else who gets a call from these guys files the same complaint.

Check you credit report and check the statute of limitations. These guys but old debt for pennies on the dollar and will threatened you with lawsuit and wage garnishment. They may be able to do this but if your old debt was written off and the statue of limitations has expired then you don't have to pay anything. These guys will lie to you about the statute of limitations on your debt. I was told that statute of limitations on my debt for my state was 10 years... Wrong.. it's 4 and my personal accounts statute of limitations has expired. I know we all have our reasons for not paying our debt. I think you should pay if your able but that's always not the case. GL to all and check your statute of limitations on your debt. It's the LAW

I received a call today from christy clark. She left a message on my cell phone and my house phone. My debt is past the sol and she said on message that she will put a lean on my taxes and all aother accounts I have. She said the sheriff will be coming to serve me papers and I will be charged with 3 criminal charges and have to pay over 11k by the time she is thru with me. She also said she all ready contacted the court where I live. I saw alot of complants on budhibbs.com about this company but I do not know what is real and what is a scam anymore. Just when I think I am getting things together something like this comes up.

I just read 'so grl' message.

I have never posted a message on this site before but I just want to say that this is the same exact thing that happened today, same person same dollar amounts, and exact same threat. I live in Illinois and the SOL has expired. I had been trained on FDCPA practices and I know for sure that what they are doing is illegal. They cannot leave such a message with a third party (answering machine inclueded). Something else to keep in mind that I have learned some time ago. When an attorney or collector contacts you, tell them that you need a copy of the original debt agreement (which they would not have because you did not make the agreement with them). If the case does end up in court, you need to see their 'power of attorney' issued by the creditor (which they wouldn't have either), and the case should be dismissed as they do not have the right to act on it as they are a third party.

Hope this helps, this is what I've been told.

I got a call from them last night. I was threatened that if I didn't send them the money that this morning that they were going to court and file charges against me. That it would be a felony, I would go to jail and I would lose my SSD. When my boyfriend called back he told him something different. That it was being called A breach of contract. The card in question is something I never opened. I left that county in '02 and the card was open in '03. Several payments were made and then stoppped. He said the card was opened over the phone. It was for $300 and now the dept is$2500. I called my local police and they are having me file a police report and contacting the DA in my area.

If you cannot pay off a credit card debt, it is not a criminal offense and so they cannot send you to jail. Again your social security benefit will not be stopped for non payment of credit card debt. Moreover, the creditor cannot even garnish your social security benefit to recover the debt.
Since a credit card was opened without your authorization, I think that it is a case of identity theft and so you should file a complaint with the FTC so that you can become a registered victim of identity theft.

This company has contacted me about an old debt. We had made a settlement on it when the amount was appox 2100. I told them that we had already paid it. They asked for a copy of the check. It's been 3 or 4 years ago. I don't have it anymore. I said that I wanted proof that we owed anything, now its over 7000. He told me he didn't have to prove anything at all to me. Nothing about this seems right. Now they are saying since I'm being uncooperative they will just have to file suit? Does anyone have any suggestions. Do I just ignore???

Update:
Please read my last few posts in this thread about my run in with kingman cole and their non sense.

OK, game over! After the last phone call I got from this guy, I did everything I could to report them because I felt I was in the right. I followed the process laid out in another thread about how to file a complaint about a possible scam against you. Called my local authorities who sent a cop over to my house to file a report. Left a complaint with my state and the state of NY BBB and did a few other things I can't remember off hand. Took a few hours to make all the phone calls and file all the reports (electronically), but in the end, the BBB of NY helped me out.

After about 3-4 weeks from my report on Kingman cole, the NY BBB sent me a letter saying they had followed up on my report and contacted Kingman who was dropping the case against me. They reported that it was due to the little amount they claimed I owed. Funny... Just a few weeks earlier, this guy made it seemed like this "little amount owed" would be enough to take me to court and put me in jail!!! LOL.. I report him and bada-bing, it's over.

So.. I KNOW FOR A FACT I payed my debt to the company he claimed I owed. Did I have proof I payed it? No! It was a debt from many years ago. Still, my credit report is SPOTLESS so I knew I could fight them. Glad I did.

Good luck to everyone else fighting these guys. Don't hesitate to report them any way you can. Google the name and you'll find a website that directs you exactly how to report them if you can't find it here. FIGHT THEM TO THE END!!!

Hi Nic and Hi all, funny I just received a phone call same as you an old debt from a credit card from 2004 that I owed 2500 but they are willing to settle for 1500 dollars, I called the bank in question, do not owe them anything, I did have a credit card with them, but all paid off, the credit reports show nothing aswell, they send me even a bill fro 1500 froom Kingman, and Funny that email was from Mr JENNINGS aswell...
What can I do to help you guys closed their company , they should not even be allowed to existe, and their website should not exist, I will do anything I can to help you all, let me know what I can do !!!! LEt's make them suffer !!!! and Audited, because some people probably paid too !!!!
