Subject: Options after default judgment entered?

Posted on Sat Nov 14, 2009 12:16 am

My BF recently had a default judgment entered against him as a result of some unpaid credit card debt. Does he still have the leverage to make a settlement offer (for less than the full amount of the debt) before they seek a wage garnishment order? What's the ballpark time frame between the judgment being entered and the garnishment of wages in the state of CA?

As long as he hasn't went to court yet and the judge granted the creditor to garnish his wages. It is still possible to try and work out something with them. Now whether they settle for less is up to the creditor of course. They may end up lowering his payments instead. I have seen a judgment start a week after it was granted. So I would call soon and try and work out something with them.

Subject: Lock on Funds

I recently had a creditor lock down funds in my account for almost double what I originally owed. Is that legal? Also, the same creditor locked the same amount on my account twice. After they took their judgement amount, they did it again and my bank allowed it. What legal rights do I have? I live in NY.

I just received notice that a default judgment was entered against me; I was not notified of the proceedings against me and wish to fight it. The issue is a contractor who did not fulfil his contract. what do I do now short of hiring a lawyer?
