Incorrect collection practices by collection agencys

Can some please tell me how to dispute a credit agencys report which says I owe a bill from Assett collections LLC that became past due in 2008 when they have a different acct. number from the original creditor they bought it from. Which was 2004. It was beneficial and then HSBC and then Asset collections, and now I guess they sold it to Midland credit. All the dates are wrong. I have sent out validation letters on the 27th of October by certified mail, and the got them on the 30th of Oct. The original acct is scheduled to drop off in July 2010 but the other agencys say not until Oct 2013. I dont owe this money because I paid it off back in 2003. Its the same acct number on the one in good standing and the collections one. Should I get an Atty? or just send an intent to sue letter. Thanks :cry:

Hi Ruthie,

Since you have disputed this with the orginal creditor and the collection agency and they will not correct it
. I would contact the Federal Trades Commission and let them know. They should be able to help you with this.

Thankyou to all of you. I hope to be able to help everyone to someday. I just get so stressed out lately and now I can't think straight. Thanks for all your patience and understanding. I hope this site always remains here. You guys & Gals are the best.

I have called the credit bureau today to ask why my items were not deleted. I sent out validation letters to all credits and have gotten none back. I have disputed these 6 or 7 times. I even sent all 3 credit bureaus the proof of no validation, and that they were paid by ins. bills. The giel at experian told me they can't remove these items without asking the creditor first. So why are we sending proof?? If it is all up to the creditor why bother. I called the Ftc and they filed a complaint against all three agencies, and they told me to hire a good lawyer and sue. As soon as they recieved proof it should have been removed, but these agencies aren't doing that. They have a contract with these companies to keep the bad stuff on. This girl at equifax even admitted to that. Any how, Can anyone recommend a good lawyer to settle this? I have had enpigh and if they don't want to play nice, I can sue and they have to pay for it. I have a dispute and complaint number for the FTC and I have all proof. Now what? I need a good nasty lawyer. enough is enough, I will not pay for the same debt twice. I think I will sue the insurance company as well. Anyone need more info then contact me please. Thanks Ruthie

I was at the point you are at now when I contacted the FTC and they told me to dispute it with the creditor directly they meant mail of course. But I didn't I called them and let them know that I had already spoke to the FTC and they said to dispute it with them directly and if they didn't correct it to call them back. The man put me on hold and called the credit agencies and corrected it. But I really should have sued them the more I think about it. It makes you mad how much power they have when you know you are right. Hard to tell how many times I applied for things and got turned down because they were listed incorrectly. But Of course the decisions is up to you. You can try what I did or go ahead and sue. Not sure what state you live in as far as lawyers go. Let us know how it turns out.

I agree, I am talking to a lawyer on Monday, and I think its high time someone takes a stand against these agencies. Its no wonder our society is in a depression. I didn't think they could sell your debts as bad debts or charge off's when there is insurance on them. I did my part and they claim they don't have to accept this. They are paid. I am a cancer survivor, and i guess they figured I would die and get lots of money out of my heirs. Sorry, I survived and I'm glad. This is bull and the US has to do something to these people and force credit collection agencies to stop this. It is a violation of our rights. I will keep you posted, because I am keeping a record and I am also going to send this to all the news papers and news staions I can. Like I said it's time to take a stand. Thanks Ruthie

I have sent request for validation several times, I have notified them of the SOL and they still persist. I have also asked the credit bureas for validation, and they too are not doing there job. Equifax says they don't have to validate for there customers give them accurate info. No ,matter what i do its always the same answer. Is it true that all the credit reporting agencies get paid for not responding to us? I have heard that they have contracts with the creditors. What else can I do, I also sent them all proof, but to no avail. I have also contacted the atty generals office but again no response.
