I have an auto loan that I just found out last week was charged off in Aug 2009. I have been making payments since then. I found out it was charged out b/c they emptied out my bank account. I was never notified by mail or phone call. Although they claim to have notified me by mail. My question is, they are requesting my work phone number do I have to release? Do I have any other rights here. The are going to offer me a short term settlement...

this sounds like there was a judgment against you. I would go to the court house and look at the file. there should be papers concerning the authorization to take money from your account. there should be a docket number and a court location

They called it a right to offset, I had a loan with the same bank that I have a checking out with. Nothing is in the court records.

Hi Shontese,

You don't need to give out your work phone number. They may harass you over the phone. But you shouldn't try to avoid taking their calls. You can try to talk to them and work out the settlement.

do not give out your work number. Did the offset bring the loan current?
