Subject: Behind on my mortgage

Posted on Mon Aug 16, 2010 5:11 am

Hi,

I am 3 months behind on my mortgage. So, to help myself i have enrolled into a counseling service and I have a counseling session with NACA on Saturday to find out if there is anything I can do.

I want to save my home but if I can't how long do I have before I am required to move out? I live in South Carolina but really don't understand the Foreclosure law. Will I be notified that I have 30 days to leave the property?

However, I have been getting a letter stating I had 45 days to catch up the loan for some months now. I make a payment, and again when I miss it, they send another one the next month but this month I sent the payment and it bounced. I am in a mess Sad

Hi Aubree,

Yes, you will be notified of the eviction process. However, whether you will have 30 days or more will depend on the state laws, and the time taken to foreclose the property. It may vary from case to case.

Check the status of this account on your credit report. Accordingly talk to the mortgage company about your payments.

Thanks,

Aaron

I would suggest that you speak with a Foreclosure or Bankruptcy attorney about your situation. You want to make sure you are aware of all of your options to ensure that you have all the necessary tools to act to save your house. Most attorneys will provide you with a free consultation so that you can learn if they have any options available that can assist you to keep your house.
