they have no assets, they live month to month on social security only. the checking account is empty after the bills are paid every month

Your parents can contact with their creditors and explain them about your parents financial condition. If they convince, then they may consider your parents financial hardship. Otherwise, they may file a lawsuit against your parents. But you will be glad to know that social security benefits are exempted from garnishment.
