I have a collection item on my credit file. I have sent request for validation several times, I have the return receipt. But they haven’t replied. What are my options now?

Hi,

Welcome to the Creditmagic forum.

You have made the right move by sending the debt validation request. The collection agency is supposed to send you the following as described in FDCPA, section 809 (a).

Since they haven’t replied they have violated the FDCPA. You now have the option to send a second letter telling them to remove the collection listing from the credit report with immediate effect failing which you are going to file a lawsuit in the small claims court (also referred to as the "poor man's class action lawsuit") as they are in violation of the FDCPA. Once you send the letter wait and watch for the next 15-20 days what they do. They are likely to remove the collection item.

Regards,
Richard
