| Can the date of last activity be diputed on the CR? I have a charged-off acconut that has reported the DOLA in June 2003. I know I have not made anyments on this account since the year 2000. |

Hi Jake,
When you are sure of not doing any payment on the said account, the dates should not be re-aged in the credit report by the CA. Sometimes, collection agencies do it so that the reporting period remains longer hurting your credit.
You have to dispute the item with the CA to present your credit history in accurate manner. Send a copy of the letter to the CRA reporting this negative item. They should be able to run a check with the collection agency and fix the error after your dispute is found correct. Keep a copy in your folder for proof and send the letters through certified mail.
The CA can be sued for reporting negative information deliberately in your credit report and fined up to the extent of damages, usually $1000 for every FCRA violation.

You can verify the information with your original creditor if they have your file in their system. Give a call and request the info if it helps anyway.

| I have last payment on credit card as being 02/04/02.According to state of Nevada, credit card accounts are considered as 4 years, I was first contacted about this account of June 1st 2006 and a court summons was filed on August 11th 2006. I requested a validation of debt within the 30 days but never received any validation until I received the summons, they finally on December 4ht 2006 sent me copy of statements from capitol one, where do you thing am I at this time? |

Re-aging accounts is just one of the dirty tricks used. The good news is both FCRA and FDCPA protects you in that respect. You can certainly dispute based on the DLA's or open dates. _________________ Michael Todd

Subject: Inaccurate Information on Credit Reports Re-Aging

Sandy,
I have a question about your situation, since mine is so similar to yours.
Does anything odd or unusual appear on the statements that you received from Capital One?
In particular, for the direct date of August 11th?
Did they include copies of your cancelled checks for any payments or receipts for transactions?
I also have a few questions relating to SOL for this board.
I was sued by Capital One on Aug. 11th, 2006, same date as Sandy received her summons.
My defense was based on SOL original debt from Fl. (SOL 4 yrs.)
and I live in MI. (SOL 6 yrs.)
My Equifax CR states both DOLA and DOLP as May, 2000.
My own motion for summary disposition is in 10 days.
I just received their statements which deflate my defense
as they show activity beyond the stated dates of May, 2000
How is it that IF they have later dates of activity they
do not report this as such?
If the later activity date would have been clearly shown on my CR
I never would have wasted the courts time with a defense motion!
How does anyone possibly ever win in a court action without
truthful, accurate information to go by?
Then, how do you track down that accurate info from the original creditor
or the lawyers, since their whole objective is to restart SOL anyway.
No, I was not tricked into making any payments, etc. to restart SOL,
but these statements clearly show "odd" entries on them and my
charge-off date on CR is 4 years AFTER the 180 days time frame
following first delinquency.
Based on all of the misleading, inaccurate info so far, how can I be sure
the photo-copies of my statements are indeed, accurate?
I hope that is a fair question.
Any thoughts or advice is very much appreciated.
